Granting a temporary construction easement to the Minnesota Department of Transportation over a portion of city-owned Lilydale Park.
Body
WHEREAS, the City of Saint Paul ("City") owns park land, Lilydale Park, located at 75 Water Street ("Park Property") near the High Bridge. The Park Property is maintained by the Department of Parks and Recreation ("Department"); and
WHEREAS, the Minnesota Department of Transportation ("MnDOT") is using the Park Property for work space and storage during the reconstruction of the driving surface on the Smith Avenue High Bridge; and
WHEREAS, MnDOT requires a 51,067 square foot temporary construction easement area for a 24 month period of time along the west side of Water Street and adjacent to the drip line of the High Bridge associated with the re-decking project; and
WHEREAS, MnDOT is offering to purchase said easement for Nine Thousand Six Hundred Ninety Five 00/100 Dollars ($9,695); and
WHEREAS, the Real Estate Manager has determined this to be a fair and reasonable value as determined by an appraisal and agreed to between the City and MnDOT; now, therefore be it
RESOLVED, by the Council of the City of Saint Paul, that the proper City officials are hereby authorized and directed to grant a temporary easement to MnDOT, in a form and content substantially as set forth in Exhibit A attached hereto, and to accept payment for said easement, to be deposited in the proper Department account.
