Approving adverse action against the Wine On Sale and Malt On Sale (Strong) licenses held by Mac’s 300, LLC, d/b/a Mac’s Fish & Chips at 300 Snelling Avenue South, Ste. A.

 

Body

WHEREAS, the Wine On Sale and Malt On Sale (Strong) licenses held by Mac’s 300, LLC d/b/a Mac’s Fish & Chips (License ID#20160003775) for the premises located at 300 Snelling Avenue South, Ste. A in Saint Paul was the subject of a Notice of Intent to Suspend Licenses dated November 20, 2017, stating the licensee failed to pay delinquent license and late fees; and

 

WHEREAS, the licensee was also required to submit the following information along with the license fee payment: 1) proof of Liquor Liability insurance with a 10-day notice cancellation; 2) copy of their State Sales and Use Tax Statements for the previous twelve (12) months from the Department of Revenue; 3) a completed State of Minnesota Renewal of Liquor, Wine or Club license form and 4) a completed Certificate of Compliance Minnesota Workers’ Compensation Law form; and

 

WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information to maintain the license; and  

 

WHEREAS, the licensee did not respond to the Notice of Intent to Suspend Licenses to pay the delinquent license and late fees and submit the required information; and

 

WHEREAS, the Notice of Intent to Suspend Licenses stated that if the licensee failed to pay the delinquent license and late fees and submit the required information, request a public hearing or cancel the licenses by November 30, 2017, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it

 

RESOLVED, the Wine On Sale and Malt On Sale (Strong) licenses held by Mac’s 300, LLC d/b/a Mac’s Fish & Chips (License ID# 20160003775) for the premises located at 300 Snelling Avenue South, Ste. A are hereby suspended.   

 

FURTHER RESOLVED, the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit required insurance information in order to maintain the license.

 

FINALLY RESOLVED, the Wine On Sale and Malt On Sale (Strong) licenses will remain suspended until the delinquent license and late fees are paid in full and the required information is submitted to the Department of Safety and Inspections.
