Establishing a designated large event zone around Xcel Energy Center during the 2018 National Football League (NFL) Super Bowl LII and related events, where temporary sales, vending, entertainment, signage and related special event permits may be approved or issued by the City of St. Paul after notifying the NFL.

Body

WHEREAS, the Minnesota Super Bowl Host Committee, the NFL, and the City of St. Paul will host Super Bowl LII related events taking place on multiple days from January 26, 2018 through February 5, 2018; and

WHEREAS, the Minnesota Super Bowl Host Committee and the NFL have requested that certain temporary commercial activities near Xcel Energy Center, located at 199 West Kellogg Boulevard, and other designated sites hosting official Super Bowl game activities be lawfully regulated in a manner to ensure that the focus of the event remains on the fans, athletes, coaches, and the game and to prevent illegal marketing and vending activities and other unpermitted commercial or promotional activities; and

WHEREAS, the City of St. Paul understands that experiences in other cities where failure to regulate temporary structures, outdoor sale/distribution of merchandise and temporary outdoor advertising displays visible from public streets in the vicinity of Super Bowl events have resulted in pedestrian and vehicular traffic issues that caused traffic and pedestrian safety problems, obscured lines of sight, and affected public safety operations; and

WHEREAS, The City of St. Paul desires to promote and protect the safety and convenience of drivers and pedestrians in areas with events related to Super Bowl game activities; and 

WHEREAS, the City of St. Paul desires to respect and validate individuals’ and groups’ First Amendment and other Constitutional rights; and 

WHEREAS, the City of St. Paul will retain its full authority to grant or deny applications for any such temporary permits or licenses and will administer such authority in accordance with all applicable laws, ordinances and regulations, and, in considering whether to issue such permits or licenses, it is the City’s intent that constitutional rights will preempt all other considerations;

NOW THEREFORE BE IT RESOLVED, by the City Council of the City of St. Paul: That during the time period of January 26th, 2018 through and including February 5th, 2018 no permit or license shall be approved or granted by the City of Saint Paul which would allow the sale, free distribution, peddling or any transient merchant activities related to NFL/Super Bowl merchandise unless the permit is being sought by the NFL, Super Bowl Host Committee or other licensed NFL vendor. 

Any other permit or license for food/beverage services, temporary beverage alcohol premise expansions, block events, parades, races, the use of temporary structures, tents, signs, banners, posters, pennants, mobile billboard vehicles, broadcast vehicles, amplified sound permits, temporary light displays, video screens, projected images, building wraps, inflatable displays or temporary entertainment venues on public or private property issued by the City of Saint Paul during the time period of January 26th, 2018 through and including February 5th, 2018 within the geographical areas surrounding Xcel Energy Center described below shall issue only after the City provides notification to the NFL. 

“All that part of the City lying between 6th Street West, where it intersects with Main Street North, easterly along 6th Street West to Washington Street, south along Washington Street to Kellogg Boulevard West (to include the Minnesota Science Museum), westerly along Kellogg Boulevard West to Eagle Street, northwesterly along Eagle Street to Kellogg Boulevard, northwesterly along Kellogg Boulevard to Smith Avenue North, northeasterly along Smith Avenue North 6th street West.”

BE IT FINALLY RESOLVED, that the NFL licensing official may submit requests in writing for additional restricted geographical areas surrounding officially recognized, but as yet undetermined, 2018 Super Bowl game events.
