Pertaining to an Amendment No. 1 to Site Lease Agreement with T-Mobile Central LLC to provide for the installation of additional wireless equipment at the Sterling Avenue Water Tower site located at 645 South Sterling Avenue in Maplewood.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul approved a water tower site lease agreement dated October 11, 2005, whereby the Board leased space to T-Mobile Central LLC for the operation of wireless communication equipment at the Board’s Sterling Avenue Water Tower site located at 645 South Sterling Avenue in the city of Maplewood (the “Lease”); and
WHEREAS, the parties wish to further amend the Lease at this time to allow for the installation of additional equipment on the water tower and to eliminate caps on reimbursement of the Board’s engineering costs incurred by the installation of wireless equipment; and
WHEREAS, staff has prepared an Amendment No. 1 to Site Lease Agreement, which provides such revisions, with all other terms and conditions to remain unchanged; and
WHEREAS, the assistant city attorney has approved said Amendment No. 1 to Site Lease Agreement as to form; now, therefore, be it
RESOLVED, that Amendment No. 1 to Site Lease Agreement between the Board of Water Commissioners and T-Mobile Central LLC providing for the installation of additional equipment on the water tower and the elimination of caps on reimbursement of the Board’s engineering costs incurred by the installation of wireless equipment at the Board’s Sterling Avenue Water Tower site located at 645 South Sterling Avenue in the city of Maplewood is hereby approved, and that the proper officers are hereby authorized and directed to execute said Amendment No. 1 on behalf of the Board.
