Purpose of Appeal:  Owner would like clarification on why finished attic cannot be used s living space and possible remedies.

Legislative Hearing Staff Comments:  These orders are from April and there are a couple of apppointment letters which happened after.  We took the appeal because the notes in the Amanda system implied the inspector had spoken to the owner about appeal.  We also provided the owner with a Building Code appeal form to go to Steve Ubl and indicated we would not make a determination on use of the attic as a sleeping/living space.  He said he had other issues, as well...  -MM 

 

Body

WHEREAS, in the matter of Appeal of Robert Tyler to a Fire Certificate of Occupancy Correction Notice at 1217 CHARLES AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant to September 1, 2017 on the steps; grant to October 1, 2017 for the remaining items; deny the attic space to be used as a sleeping room, noting all bedding must be removed; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
