Title

Approving a waiver of the 45-day notice requirement in order to approve Wine On Sale, Malt On Sale (Strong), Entertainment (A), and Gambling Location licenses, with conditions, to Bamboo Hut, LLC, d/b/a Bamboo Hut (License ID #20170002881) at 1626 White Bear Avenue North. 

Body

WHEREAS, Bamboo Hut, LLC d/b/a Bamboo Hut (License ID #20170002881) applied for Wine On Sale, Malt On Sale (Strong), Entertainment (A) and Gambling Location license for the premises located at 1626 White Bear Avenue North in Saint Paul; and

 

WHEREAS, the licensee requested a waiver of the 45-day notification waiting period for approval of the above-mentioned licenses; and

 

WHEREAS, the Department of Safety and Inspections received an email from District 2 Community Council Greater East Side in support of waiving the 45-day notification waiting period and approving the licenses; and

 

WHEREAS, the Department of Safety and Inspections received no other objections to waiving the 45-day notification waiting period and approving the licenses; and

 

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the 45-day waiver and approval of the licenses; therefore, be it,

 

RESOLVED, a waiver of the 45-day notification waiting period is granted along with approval of the Wine On Sale,  Malt On Sale (Strong), Entertainment (A) and Gambling Location licenses with the following conditions to Bamboo Hut, LLC d/b/a Bamboo Hut (License ID #20170002881) for the premises located at 1626 White Bear Avenue North in Saint Paul:

 

1. Per City of Saint Paul Legislative Code 409.15(a)(2), On-sale wine license shall mean a license authorizing the sale of wine not exceeding fourteen (14) percent alcohol by volume, for consumption on the licensed premises only in conjunction with the sale and service of food (menu item only). The sale of Malt (Strong) will also take place only in conjunction with the sale and service of food.

 

2.  Per City of Saint Paul Legislative Code 409.15(e), licensee must be able to show that gross receipts are at least sixty (60) percent attributable to the sale of food.

 

3.  Licensee will submit to the Department of Safety and Inspections (DSI) annual gross receipts for food and liquor for each year the license is renewed.

 

4.  The sale, service, consumption, and/or display of alcohol (i.e., wine/beer) is limited to the seating area shown on the plans dated 07/17/2017 and submitted with the application, which is the area having an address number of 1626.  No sale, service, consumption, and/or display of alcohol is permitted in the space having an address number of 1624, which is immediately adjacent to and south of the 1626 numbered space.

 

5. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, "Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment." (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.

 

6.  Licensee acknowledges that a Gambling Location license only permits an authorized charitable organization to conduct lawful charitable gambling in a manner approved by the State of Minnesota Gambling Control Board once the charitable organization has obtained a State of Minnesota Gambling Control Board Premise Permit.

 

7.  Licensee will create a video surveillance camera and lighting placement plan (Video Surveillance Plan) for the interior and exterior of the licensed premises.  Licensee will submit the video surveillance plan to The Saint Paul Police Department (SPPD) liaison with DSI for review and approval.  In accordance with the approved video surveillance plan, licensee will ensure that video surveillance camera system is in good working order, ensure it is recording 24 hours per day, ensure it can produce recorded surveillance video in a commonly used, up-to-date format, and ensure that accurate date and time of day are visible on all recorded video.  Licensee will retain recorded surveillance video for a minimum of thirty (30) days.  If an incident is deemed serious by SPPD, licensee shall make surveillance video immediately available for viewing by SPPD.  If a copy if the surveillance video for a serious incident is requested by SPPD, Licensee shall have the technology, materials and staff available to immediately make the copy. In all other cases, licensee shall provide a copy of the surveillance video to the requestor within 48 hours.

 

8.  Licensee agrees to complete video surveillance equipment (i.e., cameras, recording equipment, lighting, etc.) installation and/or modification(s) in accordance with the SPPD approved plan prior to license issuance.
