Denying a request for a stay of enforcement of Council File RLH RR 17-2 ordering the razing or removal of the structures at 865 YORK AVENUE within 15 days after the April 19, 2017 City Council Public Hearing.

WHEREAS, City Council File RLH RR 17-2 ordered the razing and the demolition of the structure of 865 York within 15 days after the April 19, 2017 City Council Public Hearing; and

WHEREAS, a request was made to the City Council by Brett Cleveland and Jason Bebeau to review this case again and to consider the possible grant of a stay of enforcement; and

WHEREAS, the Legislative Hearing Officer conducted hearings on June 27 and July 11, 2017 to review this request; and

WHEREAS, the Legislative Hearing Officer indicated that the following conditions be met:

1. provide information on adequate funds being dedicated for the project (a line of credit, sworn construction loan or a bank statement). City’s estimate the repair of the structure exceeds $50,000;
2. a signed purchase agreement;
3. provide a work plan, including timelines, for the rehabilitation of the property, including contractor bids; and
4. a vacant building registration form must be completed and filed with the Department of Safety & Inspections.

WHEREAS, the Legislative Hearing Officer recommends the Council deny the request for a stay of enforcement of Council File RLH RR 17-2 ordering the razing and the demolition of the structures at 865 York Avenue within 15 days after the April 19, 2017 City Council Public Hearing based on the failure to meet the listed above conditions; Now, therefore, be it

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter, denying a stay of enforcement of Council File RLH RR 17-2 ordering the razing and the demolition of the structures at 865 York Avenue within 15 days after the April 19, 2017 City Council Public Hearing; and be it
