Title

Authorizing execution of license agreements with Concordia University-Saint Paul and Higher Ground Academy for their use of city-owned property north of Marshall Avenue between Pascal Street and Hamline Avenue.

 

Body

WHEREAS, the City of Saint Paul ("City") owns a parcel of former railroad right-of-way (PIN No. 34-29-23-34-0008, the "City Property") located immediately north of Marshall Avenue and adjacent to property owned by Concordia University-Saint Paul ("CUSP") and Higher Ground Academy ("HGA"); and

 

WHEREAS, CUSP wishes to use a portion of the City Property for pedestrian access and data and water crossing access in connection with its use of athletic facilities adjoining both the east and west boundaries of the City Property; and

 

WHEREAS, HGA wishes to use a portion of the City Property for staff parking and the temporary placement and use of two portable classrooms; and

 

WHEREAS, the City has agreed to permit CUSP to use the City Property under a license agreement ("CUSP License"), attached hereto as Exhibit A; and

 

WHEREAS, the City has agreed to permit HGA to use the City Property under a separate license agreement ("HGA License"), attached hereto as Exhibit B; and

 

WHEREAS, the Office of Financial Services - Real Estate Section has calculated annual fee amounts for the CUSP License and HGA License, which the parties have agreed to pay in full at the outset of the license terms; now, therefore be it

 

RESOLVED, that the City Council hereby authorizes the proper city officials to: execute the CUSP License and HGA License in a form and content substantially as set forth in Exhibits A and B; accept the license fees; and deposit said fees into an appropriate account as determined by the City's Department of Public Works.
