Approving the release of a drainage and utility easement within the property located at 1455 Victoria Way.
Body
WHEREAS, Nova Academy ("Owner") owns the school property located at 1455 Victoria Way in Saint Paul (the "Property"); and
WHEREAS, Owner is planning to construct a soccer field on the Property, and is engaged in the City's site plan review process; and
WHEREAS, when the Property was replatted in 2005 as "Victoria Park," drainage and utility easements were dedicated along the borders of the platted lots; and
WHEREAS, in order for the planned construction to proceed, portions of the drainage and utility easements must be released; and
WHEREAS, Owner is now requesting the release of said drainage and utility easements, described as: That part of the drainage and utility easements dedicated in the plat of VICTORIA PARK, according to the recorded plat thereof, Ramsey County, Minnesota, lying within the northwesterly 5 feet of Outlot B and the northwesterly 5 feet of Lot 1, Block 7, said VICTORIA PARK; now, therefore be it
RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of Northern States Power d/b/a Xcel Energy - Gas Division; Northern States Power d/b/a/Xcel Energy - Electric Division; Comcast; CenturyLink; Saint Paul Regional Water Services; Verizon (MCI Network Services, Inc.); and the City's Department of Public Works - Sewer Division, the City, for itself and on behalf of said utilities, hereby waives all rights to the above-described drainage and utility easements; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced ...
