Legislative Hearing Staff Comments: There are photos of a Condemnation Placard for an immediate vacate on June 7. However, there is nothing in the orders indicating the reason this placard was placed. It is plain there are many violations, but the orders don't specifythe reason for the placard, which is a critical problem. Please follow up with me soon. -Marcia

WHEREAS, in the matter of the Appeal of Patrick Her to a Fire Inspection Correction Notice at 528 COMO AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council grant until July 17, 2017 for compliance with these items from the June 8, 2017 Fire Certificate of Occupancy Orders:
• Item 1 regarding the back stairs loose guardrails, broken steps and instability;
• Item 6 regarding the portion of this order pertaining to porch repair;
• Item 8 regarding the torn and damaged screens;
• Item 9 regarding the repair of windows with broken glass;
• Item 14 regarding the front bedroom door of unit 1 where the strike plate is missing and the doorknob is loose;
• Item 18 regarding the window in the middle bedroom of unit 1 which is difficult to open, will not stay open, is missing a latch and has chipped and peeling paint on the sash and frame;
• Item 19 regarding the lack of operating carbon monoxide alarms near the far bedrooms in both units;
• Item 20 regarding the lack of a smoke alarm near the far bedroom in unit 1 and the missing hard-wired smoke detector in the living room of unit 2;
• Item 27 regarding the black tape holding up the top cover of the kitchen stove; And Be It
RESOLVED, that if those items are in compliance, the Legislative Hearing Officer will recommend that the Council grant to September 1, 2017 for the balance of the repairs on the list; And Be It
RESOLVED, that if these items are not entirely in compliance, no further extension be granted on this appealed order; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
