Authorizing not using a Project Labor Agreement (PLA) for the Cherokee Regional Park Play Area Improvement and the Highland Community Center Play Area Replacement projects.
Body
WHEREAS, the Saint Paul City Council adopted a policy on the use of Project Labor Agreements (“PLA”) pursuant to Council File #09-584 for projects involving $250,000 or more of city money; and
WHEREAS, the Department of Parks and Recreation is undertaking improvements to the following sites using CIB or Legacy funds as noted, with project total budgets over $250,000:
Cherokee Regional Park Play Area Improvements
Project Description: The play area is to be renovated replacing old play equipment with new play equipment.
Estimated Cost: $342,000
Estimated Start Date: Summer 2017
Estimated Project Length: 3 months
Highland Community Center Play Area Replacement
Project Description: This project includes removal of trees, concrete sidewalk, retaining walls, tennis court, and play equipment, installation of new concrete walks, play equipment, safety surfacing, site furnishings, and landscaping.
Estimated Cost: $447,701.81
Estimated start date: October 16, 2017
Estimated project length: 3 Months
WHEREAS, the Department of Parks and Recreation sent a written “Notice and Request for Recommendation on the Use of a PLA” to interested parties on May 9, 2017 with one response received; and
WHEREAS, the Saint Paul Building and Construction Trades Council which stated, “Dollar Amount; Length of Project; and Multi-craft” as reasons they recommend a PLA for these projects, with no other recommendations for using a PLA; and
WHEREAS, the PLA response form offered no specifics which would indicate concerns over dollar amount, length of project, or multi-craft; and
WHEREAS, the Project Manager has recommended against the use of a PLA for the following reasons:
1) the projects are being bid as a lump sum and labor rates are established by prevailing wage labor rates which meet or exceed union rates. Labor costs and requirements as well as total project costs are already accurately established with the bid;
2) the project, while over the threshold dollar amount, is relatively small; and
3) the construction work is anticipated to take 3 months, which is not considered a long construction period. Delay of the completion date would not result in unusual losses; now, therefore, be it
RESOLVED, that the City Council finds that the above listed projects are not of a scope or nature that it will be negatively impacted if no PLA is required.
