Authorizing the Parks and Recreation Department to enter into a 10 year lease agreement with Hallie Q. Brown Inc. for the use and management of the Martin Luther King Community Center.

Body
WHEREAS, City and HQB entered into a Lease dated November 29, 1972 for portions of the Martin Luther King, Jr. Neighborhood Service Center ("Center") constructed, in part, with funds from the Department of Housing and Urban Development; and

WHEREAS, City and HQB entered into an Operating Agreement dated November 29, 1972 which stipulated that HQB was to pay nominal rent in consideration of the HUD funding and contributions made by HQB to construction of its portion of the Center; and

WHEREAS, the initial term of the Lease was for a period of forty years commencing on September 1,1972 and allowed for four successive renewal terms of ten years each; and

WHEREAS, parties did not extend the Lease at the expiration of the initial term but treated the Lease as a month to month tenancy while negotiating the percentage split of costs between the parties; and

WHEREAS, parties have reached agreement on the percentage of costs allocated to the parties, and wish to enter into a new Lease and Operating Agreement which incorporates the obligations of both the 1972 Lease and Operating Agreements, and any amendments to either as attached to this resolution; and

WHEREAS, Saint Paul Administrative Code Section 86.03(b) requires that any lease of park lands and/or recreation facilities for a term of more than one year be approved by the city council following a public hearing before the park commission; and

WHEREAS, the Parks Commission has recommended approval of this Lease with HQB as shown in the attached Parks Commission resolution; now, therefore be it

RESOLVED, that the City Council of the City of Saint Paul authorizes the Department of Parks and Recreation to enter into the attached 10 year lease agreement with Hallie Q Brown Inc. for the use and management of the Martin ...
