Approving the Liquor-Outdoor Service Area (Sidewalk) and Liquor-Outdoor Service Area (Patio) licenses with conditions for 12Welve Eyes Brewing, LLC, d/b/a 12Welve Eyes Brewing (License ID #20170000330) at 141 Fourth Street East, Ste. LL2.

Body

WHEREAS, 12Welve Eyes Brewing, LLC d/b/a 12Welve Eyes Brewing (License ID #20170000330) applied for a Liquor-Outdoor Service Area (Sidewalk) and a Liquor-Outdoor Service Area (Patio) license for the premises located at 141 - 4th Street East, Ste. LL2; and

WHEREAS, the licensee also applied for a Liquor On Sale-Sunday; Malt-Off Sale (Brewery); and a Malt On Sale (Brewery Taproom) license; and

WHEREAS, the premises is located downtown so a petition is not required; and

WHEREAS, the Department of Safety and Inspections received no objections to the issuance of the Liquor-Outdoor Service Area (Sidewalk) and the Liquor Outdoor Service Area (Patio) licenses; and

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the Liquor-Outdoor Service Area (Sidewalk) and Liquor Outdoor Service Area (Patio) licenses; now, therefore, be it,

RESOLVED, the Liquor-Outdoor Service Area (Sidewalk) and a Liquor Outdoor Service Area (Patio) licenses are hereby granted to 12Welve Eyes Brewing, LLC d/b/a 12Welve Eyes Brewing (License ID #20170000330) for the premises located at 141 - 4th Street East, Ste. LL2 in Saint Paul with the following conditions:

1.                     Licensee agrees to restrict the number of seats and the area of table/chair placement on both the public sidewalk and the private patio areas to the number of seats/areas shown on the approved seating plans on file with the Department of Safety and inspections (DSI).

2.                     Licensee agrees to take appropriate action(s) to ensure that the sale, display and/or consumption of alcoholic beverages is contained within the defined areas as per the approved seating plans on file with DSI.  This includes service for both the indoor and outdoor areas.

3.                     Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e. sidewalk) the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective April 1 and expires on October 31 of each year, that table(s) and/or chair(s) may not be placed in the public right-of-way before or after the effective/expiration dates, and that failure to comply with this condition will result in adverse action being taken against all of their licenses.

4.                     Licensee acknowledges that a DSI approved service route is required for continued use of the Liquor Outdoor Service Area (Patio) area, which may require the licensee to maintain an active Liquor Outdoor Service Area (Sidewalk) license and Public Works Obstruction Permit.

5.                      Licensee agrees that if an Obstruction Permit and Liquor Outdoor Service Area (Sidewalk) license are required to maintain an approved service route to the patio area, they will abide by any requirements and/or service limitations placed on these approvals, and acknowledges that alcohol service to the patio area must discontinue if these approvals cannot be maintained.
