Authorizing the negotiation and execution of solar garden subscription agreements for up to 8 megawatts with GreenMark Solar, LLC.

 

Body

WHEREAS, MN Statues of 2015 216B.1641 allowed for the formation of Community Solar Gardens, centrally located solar photovoltaic systems to provide electricity to participating subscribers, and directed the Minnesota Department of Commerce to develop a monetary credit for entities purchasing electricity from such gardens, causing the City of Saint Paul to express interest in the program to attain renewable energy goals and potential cost savings; and

WHEREAS, GreenMark Solar, LLC, has indicated that it has at least 4 megawatts of solar electrical generation capacity available for sale to the City of Saint Paul from community solar gardens currently in development, with the possibility of up to 8 megawatts of capacity pending final development plans; and

WHEREAS, the Mayor and the Director, Office of Financial Services have determined that purchasing this solar electrical generation capacity from GreenMark Solar, LLC, advances the City’s renewable energy goals while providing significant potential cost savings to the City;

NOW, THEREFORE, BE IT RESOLVED, the Saint Paul City Council approves the selection of GreenMark Solar, LLC, for a subscription to Community Solar Gardens currently under development; and

FURTHER RESOLVED, that the Mayor, City Clerk and Director, Office of Financial Services, or their respective designees are hereby authorized to execute one, or multiple, subscription agreements, in the form attached, with GreenMark Solar, LLC, effective upon final execution, and with a term of 25 years from the Date of Commercial Operation, which is defined in the Agreement for each of the Community Solar Gardens; and

FURTHER RESOLVED, that the Mayor, City Clerk and Director, Office of Financial Services, or their respective designees are hereby authorized to execute Agreements sufficient to purchase up to 8 megawatts of solar electrical generation capacity; and

FURTHER RESOLVED, that the Mayor, City Clerk and Director, Office of Financial Services, or their respective designees are hereby authorized to approve and execute any amendments to the above documents for each of the Community Solar Gardens, in a form approved by the City Attorney’s Office.
