Required Background Information
On October 3, 2016, an Environmental Assessment Worksheet (EAW) was prepared for the proposed project. On November 9, 2016, the thirty-day public comment period ended for the proposed project. On February 2, the Findings of Fact and Record of Decision was completed and sent to all parties. On February 13, the Board of Zoning Appeals (BZA) duly conducted a public hearing where all persons interested were afforded an opportunity to be heard. However, the BZA laid the matter over because the vote was 3-1 and not enough Board Members present to make the vote final. On February 27, the BZA laid over the matter because the minutes were not complete and accurate enough for the Board Members to vote. On March 13, the BZA approved the request on a 4 -1 vote. The applicant is appealing the BZA's decisions on ground that the decision for approval was not based on facts and inaccuracies.
