RESOLVED, that the Council of the City of Saint Paul does hereby appoint, upon request of the City Attorney and for the purpose of preventing an impermissible conflict of interest on the part of the City Attorney, the firm of Jardine, Logan & O’Brien under the direction of attorney Joseph Flynn as special counsel representing Saint Paul Police Officer Brett Palkowitsch in the matter of Frank A. Baker v. Brian Ficcadenti, Brett Palkowitsch, Brian Norwicki, Anthony T. Spencer and Joseph M. Dick, acting in their individual capacities as St. Paul police officers, Mark Ficcadenti and Mark Ernster, acting in their individual and official capacities as supervisors,, John Does 1-2, acting in their individual and official capacities as supervisory St. Paul police officer, Thomas E. Smith, acting in his individual capacity as the Chief of Police, and the City of St. Paul, and be it
FURTHER RESOLVED, that the compensation to be paid for the services of said special counsel shall be in accordance with the City Attorney Fee Policy established for the appointments of all such special counsel now and in the future, and the total fees to be paid to said special counsel shall be in accord with such policy, will not exceed $225.00 per hour, shall be reasonable and shall take into account the factors listed in Rule 1.5 of the Rules of Professional Conduct.
