Approving adverse action against the Liquor On Sale-2AM Closing license held by 411 Minnesota Street, LLC, d/b/a Doubletree By Hilton Saint Paul.

WHEREAS, the Liquor On Sale-2AM Closing license held by 411 Minnesota Street, LLC d/b/a Doubletree By Hilton Saint Paul (License ID #20130000646) for the premises located at 411 Minnesota Street in Saint Paul was the subject of a Notice of Intent to Suspend License (“Notice”) dated December 15, 2016 stating the Department of Safety and Inspections (DSI) received a letter from the Minnesota Department of Public Safety, Alcohol and Gambling Enforcement Division (AGED) stating the licensee’s State of Minnesota 2AM license expired on July 8, 2015; and
WHEREAS, without an active State 2AM license, the licensee is not allowed to operate past 1:00 a.m. in the City of Saint Paul, and was instructed in the (“Notice”) regarding the steps to take in order to renew their State 2AM license or their City Liquor On Sale-2AM Closing license would be suspended; and
WHEREAS, the licensee called to say they no longer operate past 1:00 a.m. and no longer need the State 2AM license and the City’s Liquor On Sale-2AM Closing license; and
WHEREAS, the licensee was then instructed to send a letter to DSI cancelling their City Liquor On Sale-2AM Closing license; and
WHEREAS, the licensee failed to follow-up after the phone conversation to either provide proof of the renewal their State 2AM license or send a letter cancelling their City Liquor On Sale-2AM Closing license; and
WHEREAS, per Saint Paul Legislative Code §310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information to maintain the license; and
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to provide proof of the renewal their State 2AM license or send a letter cancelling their City Liquor On Sale-2AM Closing license or request a hearing by December 26, 2016,...
