Required Background Information
On December 5, the Board of Zoning Appeals (BZA) duly conducted a public hearing where all person interested were afforded an opportunity to be heard. However, the BZA laid the matter over because they wanted input from the District Council. The District Council subsequently sent a letter of support. On December 19, the BZA denied the request on a 4 to 3 vote. The applicant is appealing the BZA's decision on grounds that the decision for denial was not based on the facts that he has met the guidelines and has the support of the District Council.
