Title

Resolution Authorizing and Approving the Conveyance of the North Half of Vacated Woodward Avenue and Part of East Street to Lombardo Family LLLP and Acceptance of an Access Easement over Entire Vacated Woodward Avenue and Part of East Street, Payne-Phalen District 5, Ward 7.

Body

WHEREAS, the City of Saint Paul (“City”) by RES PH 16-119 has approved the petition of State Supply and Lombardo Bros., LLC for Lombardo Family LLLP, as Adjacent Property Owner (“Lombardo”) and has vacated certain portions of right of way over Woodward Avenue and East Street abutting 597 7th Street East (“Vacated Woodward and East”); and

 

WHEREAS, Lombardo is the property owner of the adjacent real estate south of vacated Woodward and East; and

 

WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (“HRA”)  is the property owner of the adjacent real estate north of vacated Woodward and East (“North portion of Vacated Woodward and East”); and

 

WHEREAS, HRA and Lombardo have entered into a Real Property Agreement whereby HRA will convey the North portion of Vacated Woodward and East to Lombardo and accept conveyance of an Access Easement across the entire Vacated Woodward and East.

 

NOW THEREFORE BE IT RESOLVED by the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, as follows:

 

                     1.                     That the conveyance by the HRA of the North portion of Vacated Woodward and East legally described as follows:

 

That part of the north half of Woodward Ave, formerly known as Woodward Street, vacated, adjoining Blocks 7 and 12, BRUNSON’S ADDITION TO THE TOWN OF ST. PAUL, according

to the recorded plat thereof, Ramsey County, Minnesota, lying easterly of a line drawn from the  northwest corner of Lot 4, said Block 12, to the southwest corner of Lot 4, said Block 7, and that

part of East Street lying between the south line of said north half of Woodward Street, vacated, and the south line of said Block 7 extended easterly and westerly of the westerly line of the

Ramsey County Regional Railroad Authority, formerly Northern Pacific Railway, right-of-way.

 

to Lombardo is approved and that a Deed of Conveyance is authorized by the Board of Commissioners to be executed on its behalf by the Chairperson or his or her designated Commissioner of the HRA.

 

            2.        That the Access Easement from Lombardo to HRA for the Vacated Woodward and East is approved and accepted.

 

      3.        The Real Property Agreement between the HRA and Lombardo is hereby approved and the Executive Director is authorized and directed to execute such agreement on behalf of the HRA.

 

      4.        The HRA Executive Director and staff are authorized and directed to take all actions needed to implement this Resolution.
