Approving adverse action against the Cigarette/Tobacco license held by Tony’s Amoco, Inc., d/b/a Tony’s Amoco, Inc. at 374 Lexington Parkway North.

 

Body

WHEREAS, the Cigarette/Tobacco license held by Tony’s Amoco, Inc. d/b/a Tony’s Amoco, Inc. (License ID #20010001039) for the premises located at 374 Lexington Parkway North in Saint Paul, was the subject of a Notice of Violation dated November 1, 2016, stating an employee of the licensee sold tobacco products to an underage person on October 20, 2016 in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (c) and (d); and

 

WHEREAS, this was the third violation within the past twenty-four (24) months; therefore, per Saint Paul Legislative Code § 324.11(b) (1), the licensing office recommended an $800.00 matrix penalty and seven (7) day suspension of his Cigarette/Tobacco license; and    

 

WHEREAS, the licensee did not respond to the Notice of Violation to request a public or administrative hearing; and

 

WHEREAS, the Notice of Violation stated that if the licensee failed to request a public or administrative hearing by November 14, 2016, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it

 

RESOLVED, Tony’s Amoco, Inc. d/b/a Tony’s Amoco, Inc. is hereby ordered to pay an $800.00 matrix penalty for the sale of tobacco products to an underage person on October 20, 2016.

 

Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.   

 

FURTHER RESOLVED, the Cigarette/Tobacco license held by Tony’s Amoco, Inc. d/b/a Tony’s Amoco, Inc. is hereby suspended for a period of seven (7) days.  Said suspension will begin at 12 a.m. (midnight) on Wednesday December 28, 2016 and end at 11:59 p.m. on Tuesday, January 3, 2017.
