Title

Pertaining to a new Site Lease Agreement with T-Mobile Central LLC to provide for continued wireless operations at the Board’s Highland Water Tower No. 2 site located at 750 South Snelling Avenue in Saint Paul.

 

 

Body

WHEREAS, the Board of Water Commissioners approved a water tower site lease agreement dated September 25, 1996 whereby the Board leased space to APT Minneapolis, Inc., predecessor in interest to T-Mobile Central LLC, for the operation of wireless communication equipment at the Board’s McKnight Road Standpipe site located at 750 South Snelling Avenue in the city of Saint Paul; and

WHEREAS, said site lease agreement will expire on December 31, 2016 and T-Mobile Central LLC desires to continue its wireless operations at the site; and

 

WHEREAS, staff has negotiated a Site Lease Agreement to provide for such continuation of operations, which includes a 5-year term beginning January 1, 2017 that automatically renews for three additional 5-year terms, a starting annual rent of $46,650, a 5% annual rent escalator, and terms and conditions consistent with the protection of Board operations; and

 

WHEREAS, the assistant city attorney has reviewed said Site Lease Agreement and has approved it as to form; now, therefore, be it

 

RESOLVED, that the Site Lease Agreement between the Board of Water Commissioners of the City of Saint Paul and T-Mobile Central LLC allowing for the installation and operation of a wireless communication system at the Board’s Highland Water Tower No. 2 site located at 750 South Snelling Avenue in the city of Saint Paul is hereby approved, and that the proper officers are hereby authorized and directed to execute said Site Lease Agreement on behalf of the Board; and, be it

 

FURTHER RESOLVED, that the Honorable Council of the City of Saint Paul is hereby requested to approve said Site Lease Agreement and to authorize and direct the proper officers of the City of Saint Paul to execute said Agreement on behalf of the City.
