WHEREAS, in the matter of Appeal of Glenn Bartelmy, on behalf of owner Samantha Bartelmy, to a Notice of Condemnation-Unfit for Human Habitation-Order to Vacate at 1323 BUSH AVENUE, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and
WHEREAS, the Legislative Hearing Officer recommends that the City Council deny the appeal and grant until December 5, 2016 January 1, 2017 for two of the three families in the property to be vacated and the owner and inspector will work to ensure the remaining occupied unit is code compliant, noting if owner wants to use as a duplex, it will require a zoning variance; Now, Therefore, Be It
RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
