Authorizing entrance into Minnesota Department of Transportation Agency Agreement No. 1025948 allowing the Commissioner of Transportation to act as the City’s agent to accept federal aid funds for a preliminary multimodal design study of the Canadian Pacific Rail Spur (Ward 3, District 15 and Ward 2, District 9).

WHEREAS, The United States Department of Transportation (“DOT”) has awarded a $100,000 grant (“Grant”) to the City of Saint Paul to be used in the preparation of a preliminary design study (“Design Study”) of the Canadian Pacific (CP) Rail Spur that will identify constraints and opportunities for multi-modal use and develop preliminary design concepts; and
WHEREAS, on July 6, 2016, City Council accepted the Grant in Res PH 16-203; and
WHEREAS, the Minnesota Commissioner of Transportation, pursuant to Minnesota Statutes §161.36, may act as the City’s agent in accepting federal funds;
NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Saint Paul authorizes entrance into “Minnesota Department of Transportation Agency Agreement No. 1025948” allowing the Commissioner of Transportation to act as the City’s agent to accept federal funds.
BE IT FURTHER RESOLVED that the City Council of the City of Saint Paul approves the indemnity clause contained in §1, Paragraph I of Agreement No. 1025948.
BE IT FURTHER RESOLVED that the Director of Planning and Economic Development and the Design Study Project Manager are hereby authorized on behalf of the City to execute Agreement No. 1025948 prescribing the terms and conditions of said federal aid participation.
