Moving 2016 CIB Contingency to the 2016 Public Works Capital Maintenance program to reimburse costs associated with soil removal on the Lafayette Triangle Parking Lot.

WHEREAS, the Lafayette Triangle Parking Lot (“Lafayette Parking Lot”) is owned by Lafayette Parking Owner (“Owner”), which was previously owned by Meritex Enterprises, Inc. (“Meritex”); and
WHEREAS, in 2006 Meritex acquired the Lafayette Parking Lot through a land swap with the City of Saint Paul (“City”) in which the City acquired land at the northwest corner of Olive and Grove Streets for police vehicle parking (“Grove Street Lot”); and
WHEREAS, the Lafayette Parking Lot was intended for eventual development as an extension to an existing adjacent parking lot owned by Owner, but there was excess soil on the property that would need to be relocated to facilitate the parking lot construction; and
WHEREAS, the City agreed in a settlement stipulation in condemnation of the Grove Street Lot to pay for the removal or relocation of the excess soil, and now the Owner is developing the Lafayette Parking Lot, thus requiring the soil removal or relocation; and
WHEREAS, the City’s Department of Public Works has worked with Owner’s contractor to verify soil quantities and costs, has inspected the work completed, and has approved the invoiced expense for the soil work of $64,034 from its 2016 Capital Maintenance program, to be reimbursed from the 2016 CIB Contingency; now, therefore, be it
RESOLVED, by the City Council of the City of Saint Paul, upon recommendation of the Mayor, that the $64,034 be transferred from the CIB budget to the Public Works 2016 Capital Maintenance budget, heretofore adopted by the Council, and hereby amended as set forth:
