Title

Pertaining to Amendment No. 1 to Site Lease Agreement with Sprint Spectrum Realty Company, L.P. to extend the term of a lease at the Cottage Avenue Standpipe site located at 2095 Clear Avenue in the city of Saint Paul.

 

 

Body

WHEREAS, the Board of Water Commissioners approved a Site Lease Agreement dated September 19, 1996 between the Board and Sprint Spectrum, L.P. predecessor in interest to Sprint Spectrum Realty Company L.P. (“Sprint”) which leased space to Sprint at the Board’s Cottage Avenue Standpipe site at 2095 Clear Avenue in the city of Saint Paul for the operation of wireless communication equipment; and

 

WHEREAS, the Site Lease Agreement expires on September 25, 2016, and the parties desire at this time to extend the expiration date to March 31, 2017 to provide time to negotiate a new lease; and

 

WHEREAS, staff has prepared Amendment No. 1 to Site Lease Agreement which provides for said extension and which also provides for an increase in annual rent to $46, 650.00 effective January 1, 2017; and

 

WHEREAS, the assistant city attorney has reviewed said Amendment and has approved it as to form; now, therefore, be it

 

RESOLVED, that Amendment No. 1 to Site Lease Agreement between the Board of Water Commissioners and Sprint Spectrum Realty Company L.P. providing for an extension of the lease term and increased rent for wireless equipment upgrades at the Board’s Cottage Avenue Standpipe site at 2095 Clear Avenue in the city of Saint Paul is hereby approved and that the proper officers are hereby authorized and directed to execute said Amendment No. 1 on behalf of the Board, and, be it

 

FURTHER RESOLVED, that the Honorable Council of the City of Saint Paul is hereby requested to approve said Amendment No. 1 to Site Lease Agreement and to authorize and direct the proper officers of the City of Saint Paul to execute said Amendment on behalf of the City.
