WHEREAS, in the matter of the Appeal of Al Bernstein and Jeff Bernstein to a Fire Certificate of Occupancy Revocation and Order to Vacate at 1225 WHITE BEAR AVENUE NORTH, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council grant an extension to September 9, 2016 for everything on the Order, except for the fence repair or removal and the driveway and parking surface which shall be brought into compliance by November 30, 2016, noting that like surfacing may repair or replace like surfacing; i. e. class 5 gravel for class 5 gravel or asphalt for asphalt;

 

WHEREAS, the Legislative Hearing Officer recommends that the City Council 1) grant an extension to November 30, 2016 for the driveway, noting that like surfacing may repair or replace like surfacing; i. e. class 5 gravel for class 5 gravel or asphalt for asphalt;  2) grant an extension to June 1, 2017 for the addition of a parking surface; 3) grant the appeal pertaining to the repair or removal of a section of chain link fence, as it appears on the survey document to belong to the property to the north; and 4) grant an extension to September 9, 2016 for the balance of the items in the orders; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
