Waiving the three-hundred (300) foot separation distance requirement from a protected use in order to issue a Liquor On Sale - 100 seats or less and a Liquor On Sale-Sunday license with conditions to Premier Management, LLC, d/b/a La Costa Mexican Restaurant (License ID #20160000962) at 194 Cesar Chavez Street.

WHEREAS, Premier Management, LLC d/b/a La Costa Mexican Restaurant (License ID #20160000962) located at 194 Cesar Chavez Street requested a waiver of the three-hundred (300) foot separation distance requirement from a protected use as outlined in Saint Paul Legislative Code § 409.06 (n), in order to issue a Liquor On Sale 100 seats or less and a Liquor On Sale-Sunday license; and
WHEREAS, a notice was sent to all property owners within three hundred (300) feet of the licensed premises and no objection was received; and
WHEREAS, Saint Gabriel Eritrean Orthodox Church, located within three-hundred (300) feet of the licensed premises, submitted a signed a petition consenting to the issuance of a Liquor On Sale 100 seats of less and a Liquor On Sale-Sunday license; and
WHEREAS, the Council finds that the application is in order and there are no grounds to deny the waiver and licenses; now therefore be it
RESOLVED, the three-hundred (300) foot separation distance requirement from a protected use as outlined in § 409.06 (n) of the Saint Paul Legislative Code is hereby waived and a Liquor On Sale - 100 seats or less license and a Liquor On Sale-Sunday license are hereby granted to Premier Management, LLC d/b/a La Costa Mexican Restaurant (License ID #20160000962) for the premises located at 194 Cesar Chavez Street with the following conditions:
1. Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a “Restaurant”.
2. Licensee agrees to close the establishment at 12:00 a.m. midnight. All patron/customers shall vacate the premises by 12:30 a.m. each day of the week as per City Zoning Code (parking requirement) and Section 409.02 of the City of Saint Paul Legislative Code.
3. No liquor sales and/or service is allowed outdoors on either public or private property without prior written consent and additional licensing from DSI.
