WHEREAS, the Solid Waste Hauler & Vehicle and Solid Waste Hauler (Each Additional Vehicle) licenses held by Coolidge Trucking Systems, Inc. d/b/a Coolidge Trucking Systems, Inc. (License ID# 20010000787) for the premises located at 829 Central Avenue West in Saint Paul was the subject of a Notice of Violation dated May 11, 2016, stating the licensee was cited by Ramsey County Public Health Department-Environmental Health Division of performing solid waste transfer activities for which the site is not licensed in violation of Ramsey County Solid Waste Ordinance Section 3.91 and Section 4.01; and
WHEREAS, the licensee does not currently hold the appropriate Solid Waste Transfer Station license required per Saint Paul Legislative Code § 357.01(a) to perform solid waste transfer activities at this site; and
WHEREAS, based on the fact that the violation is directly related to the licensed activity, per Saint Paul Legislative Codes § 310.05(m) (2), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee responded to the Notice of Violation and met with the Assistant City Attorney on May 23, 2016 to discuss the issue; and
WHEREAS, the Assistant City Attorney sent the licensee a letter on June 15, 2016, in an effort to resolve the issue and requested a response by July 1, 2016; and
WHEREAS, the licensee failed to respond to the June 15, 2016 letter by the July 1, 2016 deadline, so a public hearing was scheduled for July 20, 2016; now therefore, be it
RESOLVED, Coolidge Trucking Systems, Inc. d/b/a Coolidge Trucking Systems, Inc. is hereby ordered to pay a $500.00 matrix penalty for performing solid waste transfer activities for which the site is not licensed in violation of Ramsey County Solid Waste Ordinance Section 3.91 and Section 4.01 and Saint Paul Legislative Code § 357.01(a).
