Approving adverse action against the Auto Repair Garage license held by Afterhours Mobile Service, Inc., d/b/a Twin City Fleet Repair at 290 Larch Street. (Public hearing continued from July 6)

 

Body

WHEREAS, the Auto Repair Garage license held by Afterhours Mobile Service, Inc. d/b/a Twin City Fleet Repair (License ID #20070003991) for the premises located at 290 Larch Street in Saint Paul was the subject of a Notice of Intent to Suspend License dated April 1, 2016 stating that during an inspection on March 28, 2016 a DSI Inspector found the licensee was not in compliance with the approved side plan (#07-145589) and documented violations to license conditions #1, #5 and #6;

 

WHEREAS, the licensing office recommended an indefinite suspension of his Auto Repair Garage license due to the fact that they had been working with the licensee for several years in an effort to get him to come into compliance with his license conditions and approved site plan with no success; and

 

WHEREAS, the licensee contacted DSI regarding the Notice of Intent to Suspend License he received to request an extension until May 31, 2016 in order to complete the work required; and

 

WHEREAS, the licensee was sent a letter from DSI on May 4, 2016, giving him an extension, but informing him there would be a re-inspection on or after June 1, 2016 to confirm he has brought the licensed premises into compliance with his license conditions and approved site plan; and

 

WHEREAS, an inspector conducted a re-inspection on June 1, 2016 and documented violations to license conditions #1, #2, #4, #6, #7, #11 and #15 and the licensee still had not completed the work required to comply with the approved site plan; and

 

WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to bring the licensed premises into compliance with his approved site plan and license conditions or request a hearing by April 11, 2016, that the matter would be placed on the consent agenda to impose the recommended penalty; and

 

WHEREAS; however, the licensee did respond to the Notice to request an extension but failed to bring the premises into compliance or request a hearing so a public hearing was scheduled on July 6, 2016; now therefore be it  

 

 

RESOLVED, Auto Repair Garage license held by Afterhours Mobile Service, Inc. d/b/a Twin City Fleet Repair is hereby indefinitely suspended for failure to bring the licensed premises into compliance with license conditions and approved site plan.

 

AND BE IT FURTHER RESOLVED, the license will remain suspended until DSI conducts a re-inspection and finds the licensee has brought the licensed premises into compliance with his license conditions and approved site plan.
