Accepting a dedication of trail easement for pedestrian and bicycle access purposes over the property located at 1880 Old Hudson Road.

WHEREAS, the City of Saint Paul ("City") is requiring a permanent trail easement ("the Easement") over the westerly 10 feet of the property located at 1880 Old Hudson Road, Saint Paul, said property owned by Samir Abumayyaleh and Zuhra Abumayyaleh ("Property Owners"), in conjunction with the redevelopment of the property; and
WHEREAS, the Property Owners have agreed to provide the Easement and are now requesting that the City accept the Easement, as provided in Exhibit A attached hereto; and
WHEREAS, the Office of Financial Services - Real Estate Section has reviewed and approved the Easement as drafted and signed by the Property Owners; now, therefore be it
RESOLVED, that the Mayor and Council of the City of Saint Paul do hereby accept the Easement, in a form and content substantially as set forth in Exhibit A attached hereto, and authorize the proper city officials to record same with the Ramsey County Recorder's Office and/or Registrar of Titles.
