Pertaining to a Stipulation Agreement with the Minnesota Pollution Control Agency for operation of emergency back-up generators at the McCarrons Water Treatment Plant.

WHEREAS, in 2005, two diesel generators began operation at the McCarrons Water Treatment plant to provide back-up and time-of-day cycling of electric power; and
WHEREAS, in 2015, the Minnesota Pollution Control Agency (“MPCA”) informed the utility that an air emissions permit should have been obtained before beginning operations; and
WHEREAS, the MPCA and staff negotiated a Stipulation Agreement that established requirements for future operation of the generators, including a fine in the amount of $15,000 for not obtaining said permit, in 2005; and
WHEREAS, assistant city attorney has approved said Stipulation Agreement as to form; now, therefore, be it
RESOLVED, that the Stipulation Agreement with the Minnesota Pollution Control Agency for operation of back-up power generators at the McCarrons Water Treatment Plant is hereby approved and that the proper officers are hereby authorized and directed to execute said Agreement on behalf of the Board.
