Approving adverse action against all licenses held by Mee Lee Moua, d/b/a Malina’s Sports Bar and Grill at 691 Dale Street North.

WHEREAS, all licenses held by Mee Lee Moua d/b/a Malina’s Sports Bar and Grill (License ID #20010002326) for the premises located at 691 Dale Street North in Saint Paul were the subject of a Notice of Intent to Suspend Licenses sent April 6, 2016, stating that on March 22, 2016, the Department of Safety and Inspections (DSI) received a notice of cancellation of liquor liability insurance (Policy #00674-99358) effective February 8, 2016; and
WHEREAS, on March 31, 2016, DSI sent a letter to the licensee notifying her that she must discontinue serving all liquor until her liquor liability insurance has been reinstated or replaced and their office receives a Certificate of Insurance showing no lapse in coverage; and
WHEREAS, On April 1, 2016, the licensee submitted a certificate of liquor liability insurance (Policy #L160091) showing coverage from April 1, 2016 to June 15, 2016; however, the certificate also indicated a fifty-three (53) day lapse in coverage from February 8, 2016 through March 31, 2016; and
WHEREAS, Saint Paul Legislative Code § 409.26 (b) (12) requires that the licensee hold current liquor liability insurance without a lapse in coverage in order to continue operating the business; and
WHEREAS, as a result of this lapse in coverage, the licensing office is recommending the presumptive penalty matrix penalty of a ten (10) day suspension of all licenses; so therefore be it
RESOLVED, all licenses held by Mee Lee Moua d/b/a Malina’s Sports Bar and Grill are hereby suspended for a period of ten (10) days. Said suspension will begin at 12 a.m. on Wednesday, June 1, 2016 and end at 11:59 p.m. on Friday, June 10, 2016.
