Title

Approving a partial waiver of select requirements of the Saint Paul Sustainable Building Policy for New Municipal and HRA Owned Buildings and a partial deferral of portions of the Saint Paul Overlay, for the Police Department's new Communication Services and Maintenance Facility to be located at 1675 Energy Park Drive.

 

Body

WHEREAS, on May 26, 2010 the City Council adopted Council File No. 10-497 to implement  the Saint Paul Sustainable Building Policy for New Municipal and HRA Owned Buildings ("Sustainable Building Policy") that requires any new municipal or HRA owned facilities financed by the City of Saint Paul or HRA to comply with, and be certified through, either LEED New Construction 2.2 Silver, Green Globes - 2 globes, State Guidelines Building Benchmarking and Beyond (B3), or Saint Paul Port Authority Green Design Review construction standards; and

 

WHEREAS, said 2010 resolution further established new mandatory requirements for City and HRA Owned buildings, known as the "Saint Paul Overlay," which include standards for predicted energy and water usage, construction waste, indoor environmental quality, storm water management, predicted greenhouse gas emissions, and actual energy use; and

 

WHEREAS, the City Council approved $1,000,000 in the 2016 Capital Improvement Budget for the construction of a new 8,400 square-foot Police Communication Services and Maintenance Facility ("CSM Facility") at 1675 Energy Park Drive, consisting of 5,700 square feet of shop and garage space and 2,700 square feet of office space for eight staff; and

 

WHEREAS, a master planning process is underway with the assistance of the Office of Financial Services Real Estate Design Group for the future phased redevelopment of the larger Public Safety site at 1675 Energy Park Drive, including a phased replacement of most of the facilities, including the Fire and Safety Services training operations buildings, the Public Safety Garage and the fire apparatus storage facilities; and said new facilities in the redevelopment will be designed, constructed and operated in full compliance with the City's Sustainable Building Policy that is effective at that time, including certification through one of the allowable "green" building rating standards; and

 

WHEREAS, the cost of complying with and administering one of the "green" building rating standards would be disproportionate to the cost of constructing the CSM Facility, the City is seeking a waiver of the building certification requirement of the Sustainable Building Policy for the CSM Facility, ; and

 

WHEREAS, the requirements of the Sustainable Building Policy may be waived, in whole or in part, by the City Council after consideration of the advantages and disadvantages of a waiver, and upon showing a compelling public purpose; and

 

WHEREAS, the CSM Facility will comply with Saint Paul Overlay requirements, and will ensure a high standard of energy conservation, potable water use reduction, construction waste diversion from landfills, and indoor environmental quality  at a significantly lower cost and administrative effort; and

 

WHEREAS, due to the planned future redevelopment of the larger Public Safety site, the City is seeking a deferral of two of the five storm water management requirements in the Saint Paul Overlay - Water Quality Management and Volume Control/Infiltration - until Phase II site redevelopment work scope is designed and constructed; now, therefore be it

 

RESOLVED, that the City Council hereby waives the Sustainable Building Policy requirement for the CSM Facility regarding certification through one of the allowable "green" building rating standards; and be it further

 

RESOLVED, that the Council defers the City's compliance with the Water Quality Management and Volume Control/Infiltration requirements of the Saint Paul Overlay until the Phase II site redevelopment work scope is designed and constructed, at which time the required stormwater measures will comply with the Sustainable Building Policy effective at that time.
