Approving adverse action against all licenses held by Eastsiders Bar, Inc., d/b/a Louie’s Bar located at 883 Payne Avenue.

Body

WHEREAS, all licenses held by Eastsiders Bar, Inc. d/b/a Louie’s Bar (License ID #20120005867) for the premises located at 883 Payne Avenue in Saint Paul was the subject of a Notice of Violation - Notice of Intent to Suspend Licenses - Notice of Imposition of Stayed Matrix Penalty dated February 24, 2016, stating the licensee failed to provide video surveillance to Saint Paul Police with regard to an assault that took place inside the licensed premises on February 3, 2016.

WHEREAS, this was the third (3^rd) violation so the licensing office recommended imposition of the $500.00 matrix penalty stayed by City Council on December 16, 2015 (RES PH #15-361) as well as a $2,000.00 matrix penalty and a ten (10) day suspension of licenses; and

WHEREAS, this was the third (3rd) second appearance before Council so the licensing office recommended imposition of the $500.00 matrix penalty stayed by City Council on December 16, 2005 (RES PH 15-361) as well as a $2,000.00 $1,000.00 matrix penalty and a ten (10) day suspension of licenses; and

WHEREAS, the licensee responded to the Notice of Violation - Notice of Intent to Suspend Licenses - Notice of Imposition of Stayed Matrix Penalty to request a public hearing which was scheduled on April 6, 2016; now therefore be it  

RESOLVED, the licensee is hereby ordered to pay the $500.00 matrix penalty stayed by City Council on December 16, 2015 (RES PH #15-361) and an additional $2,000.00 matrix penalty; and 

FURTHER RESOLVED, all licenses held by Eastsiders Bar d/b/a Louie’s Bar are hereby suspended for (ten) 10 days for failure to provide video surveillance to Saint Paul Police with regard to an assault that took place inside the licensed premises on February 3, 2016.

FINALLY RESOLVED, said suspension will begin at 12:00 midnight Wednesday, April 27, 2016 and end at 11:59 p.m. Friday, May 6, 2016. 

FURTHER RESOLVED, the licensee is hereby ordered to pay a $1,000.00 matrix penalty of which $500.00 will be stayed twelve (12 months pending no same or similar incidents.

Payment of such penalties shall be made within thirty (30) days of the date of the adoption of this resolution.
