Pertaining to a Utility Easement Release over property addressed as 1147 East Seventh Street in the city of Saint Paul.

WHEREAS, the Board of Water Commissioners is successor to grantee of easement rights for water works purposes over certain property in the northwest quarter (NW ¼) of the northwest quarter (NW ¼) of the southeast quarter (SE ¼) of Section 28, Township 29, Range 22 in the city of Saint Paul, Ramsey County, Minnesota, addressed as 1147 East Seventh Street, Saint Paul, MN 55106; and
WHEREAS, said easement rights were obtained for the installation and maintenance of the now abandoned Phalen Lake conduit; and
WHEREAS, the Saint Paul Port Authority has requested that the Board release its easement rights to unencumber the title prior to registration of the property; and
WHEREAS, staff has evaluated the request and determined that said rights are not needed for the operation of the Board’s water system; and
WHEREAS, the firm of Stinson Leonard Street LLP has prepared a Utility Easement Release, which provides for release of said rights, and the assistant city attorney has reviewed and approved said Release as to form; now, therefore, be it
RESOLVED, that the Utility Easement Release of Board of Water Commissioners rights over certain property in the northwest quarter (NW ¼) of the northwest quarter (NW ¼) of the southeast quarter (SE ¼) of Section 28, Township 29, Range 22 in the city of Saint Paul, Ramsey County, Minnesota, addressed as 1147 East Seventh Street, Saint Paul, MN 55106, is hereby approved, and that the proper officers are hereby authorized and directed to execute said Release on behalf of the Board.
