Approving the release of a drainage and utility easement within the Highland Bank property at 2100 Ford Parkway.
Body
WHEREAS, Highland Bancshares, Inc. ("Owner") owns the commercial property located at 2100 Ford Parkway in Saint Paul (the "Property"); and
WHEREAS, Owner is planning to construct a stoop in front of the north face of the existing building on the Property that will encroach into a drainage and utility easement, as dedicated in the plat Highland Crossing; and
WHEREAS, in order for the planned construction to proceed, a portion of the drainage and utility easement must be released; and
WHEREAS, Owner is now requesting the release of said drainage and utility easement, described as:
The north 10.00 feet of Lot 2, Block 1, as dedicated in the recorded plat of HIGHLAND CROSSING, Ramsey County, Minnesota, except the east 20 feet and except the west 15 feet thereof,
and depicted in the "Easement Release Exhibit" attached hereto; now, therefore be it
RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of Northern States Power d/b/a Xcel Energy - Gas Division; Northern States Power d/b/a/Xcel Energy - Electric Division; Comcast; CenturyLink; Saint Paul Regional Water Services; Verizon (MCI Network Services, Inc); Ever-Green Energy, LLC for District Energy St. Paul, Inc. & District Cooling St. Paul, Inc.; and the City's Department of Public Works - Sewer Division, the City, for itself and on behalf of said utilities, hereby waives all rights to the above-described drainage and utility easements; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certif...
