Approving a request by the Saint Paul Port Authority to release a utility easement within vacated Iris Alley on its property at 600 Lafayette Road.

 

Body

WHEREAS, a request has been received from the Saint Paul Port Authority for the release of existing utility easements in vacated Iris Alley, legally described as:

 

     That part of Iris Alley not previously vacated lying between the westerly line of DeSoto Street and the southwesterly extension of the northwest line of Lot 5 as platted, Block 11, Warren and Winslow’s addition to the Town of St. Paul,

 

and depicted in the attached ALTA survey (the "Easement Area"), said vacation approved by the City Council in CF No. 272539, adopted February 20, 1979, and amended in CF No. 87-334, adopted March 12, 1987 and recorded as Ramsey County Documment Number 2375668 (Abstract); and

 

WHEREAS, Northern States Power Company, d/b/a Xcel Energy - Electric and Gas ("Xcel") has determined that its utility easements in the Easement Area may be released; now, therefore be it

 

RESOLVED, that with the accompanying Certificate of Intended Non-Use, filed voluntarily on behalf of Xcel and on file in the Office of Financial Services Real Estate Section, the City, on behalf of Xcel, waives all rights to its utility easements within the Easement Area; and be it further

 

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper City officials are hereby authorized and directed to record a certified copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution.
