Supporting The City of Saint Paul signing onto the amicus penned by Samuel Bagenstos in the case of Friedrichs v. California Teachers Association, No. 14-915.

WHEREAS, the United State Supreme Court is slated to hear the case Friedrichs v. California Teachers Association, No. 14-915 in 2016;

WHEREAS, a decision to overrule Abood v. Detroit Board of Education, 431 U.S. 209 (1977), has a potential to directly impact groups with collective bargaining agreements that currently exist with the City of Saint Paul;

WHEREAS, the Public Employment Labor Relations Act in Minnesota clearly lays out the relationship between public employers and their employees to promote orderly and constructive relationships between all public employers and their employees.;

WHEREAS, the decision in the case has the prospect to destabilize existing contractual relationships in the City of Saint Paul;

WHEREAS, a decision in this case has the prospect to impact the voice of workers in their workplace and undermine governmental interest in the efficient delivery of public services;

WHEREAS, a decision in this case has the prospects to undermine cooperative labor-management arrangements that have in the past led to improved services and cost savings to municipalities

BE IT RESOLVED, the Saint Paul City Council join Mayor Coleman in supporting the City of Saint Paul signing onto the amicus brief penned by University of Michigan Professor Samuel Bagenstos outlining why and how municipalities support maintaining our current system for collective bargaining that could be impacted by the US Supreme Court’s decision in the case of Friedrichs v. California Teachers Association, No. 14-915:
