Title

Approving adverse action against the Peddler license held by Jason L. Gabbert d/b/a Metro Tickets for the City of Saint Paul. (To be withdrawn.)

 

Body

WHEREAS, the Peddler license held by Jason L. Gabbert d/b/a Metro Tickets (License ID #20020000789) for the City of Saint Paul was the subject of a Notice of Violation sent on October 9, 2015, stating the licensee hired three (3) unlicensed people to serve as agents for him and sell advance tickets outside the Minnesota State Fair on September 7, 2015 in violation of Saint Paul Legislative Code § 345.02 and Saint Paul Legislative Code § 345.07; and

 

WHEREAS, these violations are directly related to the licensed activity; therefore, per Saint Paul Legislative Code § 310.05 (m) (2) the licensing office recommended a $500.00 matrix penalty; and

 

WHEREAS, the Notice of Violation was sent to the licensee’s last known address and two (2) alternate addresses on file and two of the letters were returned by the U.S. Postal Service; and

 

WHEREAS, the licensee did not respond to the Notice of Violation to pay the $500.00 matrix penalty or request a public or administrative hearing; and

 

WHEREAS, the Notice of Violation stated if the licensee failed to pay the $500.00 matrix penalty or request a hearing by October 19, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it

 

RESOLVED, Jason L. Gabbert d/b/a Metro Tickets is hereby ordered to pay a matrix penalty of $500.00 for allowing three (3) unlicensed people to serve as agents for him and sell advance tickets outside the Minnesota State Fair on September 7, 2015. 

 

Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
