Approving a Liquor Outdoor Service Area (Patio) license to L & E of St Paul, Inc. d/b/a Bay Street Grill and Bar (License ID #20100000617) for the premises located at 731 Randolph Avenue in Saint Paul.

WHEREAS, L & E of St Paul, Inc. d/b/a Bay Street Grill and Bar (License ID #20100000617) applied for a Liquor Outdoor Service Area (Patio) license for the premises located at 731 Randolph Avenue; and
WHEREAS, the licensee currently holds a Liquor On Sale 100 Seats or less; Liquor On Sale-Sunday; an Entertainment (A) and a Gambling Location license; and
WHEREAS, the licensee was able to obtain thirty-three (33) out of fifty-four (54) possible petition signatures for sixty-one percent (61%) support of a Liquor-Outdoor Service Area (Patio) license; and
WHEREAS, the Department of Safety and Inspections received no objections to the issuance of the license; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the license; now, therefore, be it,
RESOLVED, a Liquor Outdoor Service Area (Patio) license is hereby granted to L & E of St Paul, Inc. d/b/a Bay Street Grill and Bar (License ID #20100000617) for the premises located at 731 Randolph Avenue in Saint Paul with the following additional conditions:
15. There shall be no amplification of music or broadcasted events outside the building.
16. Licensee agrees that each of the week all food and beverage service, including alcohol service, on the outdoor patio seating area will stop by 9:00 p.m.; that the patio will close and all customer/patrons/employees will vacate the patio area by 9:30 p.m. and that the patio area will be secured in a manner to prevent customer/patrons/employees from entering the patio area after 9:30 p.m.
