Title

Approving the application of the Department of Planning and Economic Development for a Vertical Subdivision by Registered Land Survey for property located at 27 7th Place West.  (Zoning File # 15-142134)

WHEREAS, the City of Saint Paul, through its Department of Planning and Economic Development (“PED”), in PED Zoning File # 15-142-134, submitted for City Council approval, a Subdivision by Registered Land Survey (“RLS”) for the purpose of creating tracts A, B, & C at 27 7th Place W, between St. Peter and Wabasha; and

 

WHEREAS, the manner in which the various buildings located on the tracts of the said RLS were constructed and specifically for the purpose of conveying that property commonly known as the Palace Theater, necessitated that some of the tracts be vertically delineated which required the creation of various easement agreements to define the operations of the buildings located on the RLS’s tracts; and

 

WHEREAS, the appropriate City departments have reviewed the said Subdivision by RLS [Vertical] and found, subject to the recommended conditions set forth in the Subdivision Staff Report dated September 24, 2015, as contained in the Zoning File noted above, that PED’s subdivision application meets Leg. Code Chapter 69’s subdivision requirements; and

 

WHEREAS, notice of public hearing before the City Council was duly published in the official newspaper of the City on Sept. 28, 2015, and notices were duly mailed to each owner of affected property and property situated wholly or partly within 350 feet of the subject property; and

 

WHEREAS, on October 7, 2015 the City Council held a public hearing on the proposed Subdivision - RLS [Vertical] at which all interested parties were given an opportunity to be heard, and the Council, having considered all the facts, files, and recommendations regarding the proposed subdivision; DOES HEREBY

 

RESOLVE, that the City Council accepts and approves the attached Subdivision - RLS [Vertical] to create tracts A, B, & C, subject to the following conditions:

 

The applicant shall file a copy of the Council Resolution approving the Vertical Subdivision - RLS with the Ramsey County Recorder’s Office; and

 

The property shall be brought into the Torrens system prior to approval of this RLS.

 

AND BE IT FURTHER RESOLVED, that the City Clerk shall mail a copy of this resolution to the Applicant, the Zoning Administrator, and the Planning Administrator.
