Approving the 2015 Project Implementation Agreement with Public Art Saint Paul ("PASP") for the 2015 "Everyday Poems for City Sidewalk" program.
Body
WHEREAS, the City of Saint Paul has enacted a Public Art Ordinance, Chapter 12 of the Administrative Code, which states that for all capital projects funded by eligible sources resulting in a property to be operated by the city; the city shall dedicate one (1) percent of the eligible project costs, as determined by the office of financial services, to be used for public art; and
WHEREAS, the City’s Public Works Department has worked in partnership with Public Art Saint Paul (“PASP”) for the past several years on several programs designed to incorporate public art into its capital projects, including “Everyday Poems for City Sidewalk;” and
WHEREAS, the Project Implementation Agreement between PASP and the City (Contract #651) contains an indemnification clause, which excludes indemnification for negligence on the part of PASP; and
WHEREAS, the council finds this indemnification provision to be consistent with the public purpose of the project.
NOW, THEREFORE, the City Council approves the 2015 Project Implementation Agreement with PASP for the 2015 “Everyday Poems for City Sidewalk” program.
