Title

Authorizing the acceptance of a $936 scholarship grant from the Minnesota State Historical Society for two Heritage Preservation Commissioners and one staff to attend the Preserve Minnesota Annual Statewide Historic Preservation Conference in Little Falls, September 17th and 18th, 2015.

Body

WHEREAS, the City of Saint Paul, Department of Planning and Economic Development (PED) will incur costs for two members of the City's Heritage Preservation Commission (HPC) and Historic Preservation Staff, Allison Suhan, to attend the Preserve Minnesota Annual Statewide Historic Preservation Conference in Little Falls, September 17th and 18th, 2015 ; and

WHEREAS, the City will indemnify, save and hold the Minnesota Historical Society ("MHS") and the United States Department of the Interior ("Interior"), its agents, and employees harmless from any claims or causes of action, including attorney's fees incurred by the MHS and Interior arising from the performance of this agreement by the City or the City's agents or employees only to the maximum limits of its municipal tort liability limits set forth in Minnesota Statute 466.01 et seq. and any indemnifications made by the City under this Agreement are accordingly governed and limited.  This indemnification shall not be construed as a waiver of the municipal tort liability limits set forth in Minnesota Statute 466.01 et seq.  This clause will not be construed to bar any legal remedies the City may have for the MHS' or Interior's failure to fulfill its obligations under this agreement.

WHEREAS, the Minnesota Historical Society is willing to provide a scholarship to the City for the costs of attendance by the HPC Commissioners and staff, anticipated not to exceed $936; with the remainder to be provided through PED's FY2015 Operations Fund 780 Budget.

NOW THEREFORE, be it resolved that the City Council authorizes PED to apply for, accept and enter into a grant agreement with the Minnesota Historical Society; and b...
