Title

Approval of a request to remove license condition #3 concerning a shared parking agreement with 1121 Energy Park Drive for TEW, LLC d/b/a Gabe’s By The Park (License ID #20110000244) for the premises located at 991 Lexington Parkway North in Saint Paul.

Body

WHEREAS, TEW, LLC d/b/a Gabe’s By The Park (License ID #20110000244) sent a letter to the Department of Safety and Inspections to request removal of license condition #3 concerning a shared parking with 1121 Energy park Drive for the premises located at 991 Lexington Parkway North in Saint Paul; and

 

WHEREAS, DSI sent a notification to District 10 Como Community Council and all businesses and residents within three hundred (300) feet of the premises concerning the request to remove the license condition #3 and received no comments in opposition; and

 

WHEREAS, according to Saint Paul Legislative code § 63.207, a shared parking agreement is no longer required due to recent changes affecting off-street parking requirements for a bar; and

 

WHEREAS, as a result of this ordinance change, the Council finds the request is in order and there are no grounds to denial the request to remove license condition #3 now, therefore, be it,

 

RESOLVED, license condition #3 is hereby removed from the list of license conditions held by TEW, LLC d/b/a Gabe’s By The Park (License ID #20110000244) for the premises located at 991 Lexington Parkway North in Saint Paul;

 

FURTHER RESOLVED, the following existing license conditions will be renumbered and remain on the license:

 

1.   No outdoor music.

 

2.  Closure of the patio must be by 11:00 p.m.

 

3The shared parking agreement for the parking lot at 1121 Energy Park Drive (the lot located to the west of Gabe's property) must be maintained for the duration of the liquor license.  Should the licensee's use of the spaces be discontinued, then all the use of the patio shall cease unless prior approval by the Council has been received.

 

4. 3.  The licensee agrees that it will not contract with Northtown Credit Union Topline Credit Union (976 Lexington Parkway North) for use of its parking lot.
