Title

Approving the application of Ramsey County Property Management, represented by James Homolka, Property Manager, for a sound level variance in order to conduct Ramsey County Government Center West and Adult Detention Center deconstruction at 12, 14 and 50 Kellogg Boulevard West as well as concrete crushing.

Body

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and

 

WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and

 

WHEREAS, Ramsey County Property Management, represented by James Homolka, Property Manager, who has been designated as the responsible person on the application, has applied for a variance for construction work related to deconstruct the Ramsey County Government Center West and Adult Detention Center at 12, 14 and 50 Kellogg Boulevard West as well as concrete crushing.  The variance request for concrete crushing is for ten (10) days at the end of each month of October, November, and December, 2015; and

 

WHEREAS, in order to reduce the time required for the deconstruction and to minimize disruption to traffic on Kellogg Boulevard, area businesses, the public, adjoining residents, and property owners, the applicant is seeking a variance for concrete crushing, for ten (10) days at the end of each month of October, November, and December, 2015 from 7:00 a.m. until 5:00 p.m., with work during the day and weekdays only; and

 

WHEREAS, if applicant is not granted a variance, Ramsey County will not be able to operate various pieces of equipment, including concrete crushers at 12, 14 and 50 Kellogg Boulevard West needed to complete the demolition of the Ramsey County Government Center West and Adult Detention Center; and

 

WHEREAS, the Department of Safety and Inspections has reviewed the application and has made recommendations regarding conditions for the variance; now, therefore, be it

 

RESOLVED, that the Council of the City of Saint Paul hereby grants a variance to Ramsey County Property Management, subject to the following conditions:

 

1)  The variance will be for construction work related to deconstruct the Ramsey County Government Center West and Adult Detention Center at 12, 14 and 50 Kellogg Boulevard West as well as concrete crushing. The variance request is for ten (10) days at the end of each month of October, November, and December, 2015.

 

2)  Work periods are Monday through Friday, beginning at 7:00 a.m. and ending at 5:00 p.m. 

 

3)  The Contractors working on the project will use best practicable methods for controlling noise such as, but not limited to, noise blankets, shields or portable sound barriers. Construction activities will be scheduled to minimize noise as much as possible in the evening and early morning hours.  Equipment should be fitted with manufacturer’s approved exhaust mufflers.  Sound absorption material to be installed between the concrete crushing equipment and the bluff, as well as with material surrounding the concrete crushing equipment, as approved by the Department of Safety and Inspections.

 

4)  Applicant or Contractor will notify the Department of Safety and Inspections one week prior to the concrete crushing period. Once the Department of Safety and Inspections has been notified, the Applicant or Contractor will notify in writing, affected property owners within 300 feet of the sound source a minimum of forty-eight (48) hours prior to the start of concrete crushing.

 

FURTHER RESOLVED, that any violations of the conditions set above may result in the cancellation of the variance for any remaining dates and in the denial of future requests for the granting of a sound level variance, in addition to any criminal citation which may be issued.

 

Required Background Information

Ramsey County Property Management, represented by James Homolka, Property Manager, has requested an exemption from the sound level limitations in Chapter 293.07 in order to conduct Ramsey County Government Center West and Adult Detention Center deconstruction at 12, 14 and 50 Kellogg Boulevard West as well as concrete crushing.  The variance request is for ten (10) days at the end of each month of October, November, and December, 2015, during the hours of 7:00 a.m. until 5:00 p.m.  Chapter 293.09 provides for the granting of variances from the sound level limitations contained in Chapter 293.07.
