THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN

SECTION 1

 

Section 72.15 (b) of the Saint Paul Legislative Code is hereby amended to read as follows:                    

WHEREAS, on October 17, 2014, the Federal Emergency Management Agency (FEMA) delivered to the City preliminary copies of a revised Flood Insurance Rate Map (FIRM) and Flood Insurance Study (FIS) for Ramsey County, Minnesota, which included the City; and

WHEREAS, although the revised FIRM’s contained revisions to the City’s flood hazard information, the revised FIRM did not present revised flood elevations of a flood having a one percent chance of being equaled or exceeded in any given year.  Accordingly, the City did not raise any concerns with FEMA about the preliminary revised FIRM report; and,

WHEREAS, with no concerns being raised by the City, FEMA, in a later dated March 16, 2015, advised the City that revised FIRM panel No. 27123C0116H would become effective as of September 16, 2015 and must be adopted by that date in order for the City to maintain eligibility in the national flood insurance program (Pub. L 90-448);

WHEREAS, in Legislative Code Chapter 72, the City has enacted various floodplain management regulations to guide floodplain development pursuant to Minn. Stat. § 103.F and to maintain the City’s eligibility in the national flood insurance program which includes the adoption, by reference under Leg. Code § 72.15(b), of various FIRM panels prepared by FEMA and dated June 4, 2010; and

WHEREAS, upon advice, recommendation, and initiation by the City’s Departments of Safety and Inspections and Planning and Economic Development, the City Council desires to adopt FEMA’s updated FIRM Panel No. 27123C0116H and updated FIRM Index Panel No. 27123CIND0B [reflecting the changes made to FIRM Panel No. 27123C0116H] and include them by reference in Leg. Code § 72.15(b) as amended below and that the Council further desires to adopt by reference FEMA’s Flood Insurance Study.

                                                                                                                                                                                                                                                         

SECTION 2

That Legislative Code § 72.15, entitled “Establishment,” is hereby amended such that section (b) thereof shall read as follows

(b)  The following materials are hereby adopted by reference and made a part of this code as if the material and information set forth therein were fully described herein: the Flood Insurance Study, Ramsey County, Minnesota (All Jurisdictions), Flood Insurance Rate Map Panels numbered 27123C0080G, 27123C0087G, 27123C0089G, 27123C0092G, 27123C0093G, 27123C0094G, 27123C0101G, 27123C0102G, 27123C0103G, 27123C0104G, 27123C0108G, 27123C0110G, 27123C0111G, 27123C0112G, 27123C0116G 27123C0116H, 27123C0117G, 27123C0118G, and 27123C0119G, and the Flood Insurance Rate Map Index numbered 27123CIND0B, all of these documents being prepared by the Federal Emergency Management Agency (FEMA) and dated June 4, 2010 except FIRM Panel No. 27123C0116H containing revised flood hazard information which shall became effective as of September 16, 2015 and  Flood Insurance Rate Map Index Panel No. 27123CIND0B reflecting the changes to FIRM Panel No. 27123C0116H effective as of September 16, 2015, and the Flood Insurance Study.

SECTION 3

It shall be the policy of the City of Saint Paul that any permit application subject to the requirements of Leg. Code Chapter 72, received on or after September 16, 2015 but before the effective date of this ordinance under the procedures for ordinances specified at section 6.11 of the City Charter, shall, for the public purpose of maintaining eligibility in the national flood insurance program, be reviewed for compliance with the requirements FIRM Panel 27123C0116H.

                                                                                                        

SECTION 4

 

This Ordinance shall take effect and be in force thirty (30) days following its passage, approval and publication.
