WHEREAS, the Cigarette/Tobacco license held by Midway Liquor Store, Inc., d/b/a Midway Liquor Store (License ID #20110004129) for the premises located at 1955 University Avenue West, Unit 104 in Saint Paul, was the subject of a Notice of Violation dated July 22, 2015, stating an employee of the licensee sold tobacco products to an underage person on July 17, 2015 in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (c); and
WHEREAS, this is the first violation for the sale of tobacco to an underage person, so per Saint Paul Legislative Code §324.11 (b) (1), the licensing office recommended an $200.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to pay the $200.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $200.00 matrix penalty or request a public or administrative hearing by August 3, 2015, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Midway Liquor Store, Inc., d/b/a Midway Liquor Store is hereby ordered to pay a $200.00 matrix penalty for the sale of tobacco products to an underage person on July 17, 2015.
