Approving the release of sewer and water utility easements at 51 State Street for Pier Foundry and Pattern Shop, Inc.

Body

WHEREAS, a request has been received by Pier Foundry and Pattern Shop, Inc. ("Owner") for the release of sewer and water utiltiy easements retained within a portion of Fenton Street, as vacated in Council file No. 92-918, adopted June 29, 1993 (Document Nos. 1845718 and 2759541), and located on Owner's property at 51 State Street; and

WHEREAS, said utility easements are located within the property described as:

That part of Fenton Street which lies between the northwesterly line of Alabama Street and a line parallel with and 109.00 feet northwesterly from said northwesterly line of Alabama Street;

and depicted in Exhibit A, attached hereto; and

WHEREAS, the Saint Paul Board of Water Commissioners ("Board") and the City of Saint Paul ("City") have determined that their easement rights within said vacated street may be waived, released and terminated; now, therefore be it

RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the City's Public Works Department and made a part hereof by this reference and filed in the Office of Financial Services Real Estate Section, the City hereby waives, releases and terminates its sewer utility easement rights, subject to:

1) Relocation of the existing sewer facility in vacated Fenton Street;

2) Inspection and approval of said relocated sewer facility by the City's Public Works/Sewer Division; and

3) Dedication of a new sewer utility easement for the relocated sewer facility;

and be it further

RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the Board and made a part hereof by this reference and filed in the Office of Financial Services Real Estate Section, the City hereby waives, releases and terminates, on behalf of the Board, said water utility easement rights; and be it finally
