Approving and authorizing execution of an Amendment No. 2 to Site Lease Agreement between the Board of Water Commissioners and T-Mobile Central LLC to provide for the installation of underground fiber optic cable at the McKnight Road Standpipe site located at 393 North McKnight Road in Saint Paul.

WHEREAS, the City of Saint Paul does possess fee simple title to the water tower site commonly known as the McKnight Road Standpipe located at 393 North McKnight Road, Saint Paul, Minnesota (the “Property”), such possession of title being for benefit of the Board of Water Commissioners of the City of Saint Paul (the “Board”); and
WHEREAS, the Board did adopt Resolution No. 4449 approving a Site Lease Agreement dated October 1, 1996 with APT Minneapolis, Inc., predecessor in interest to T-Mobile Central LLC, which provided for the installation and operation of wireless communication equipment at the Property, and which was approved by City Council Resolution No. 96-1177; and
WHEREAS, the Board did adopt Resolution No. 15-863 approving Amendment No. 1 to Site Lease Agreement dated May 12, 2015, which provided for additional equipment and an increase in annual rent, and which was approved by Saint Paul City Council Resolution No. 15-901; and
WHEREAS, the Board did adopt Resolution No. 15-1304 approving an Amendment No. 2 to Site Lease Agreement, which provides for the installation of a fiber optic cable within a non-exclusive easement, and which requests that the Honorable Council of the City of Saint Paul approve said Amendment No. 2; now, therefore, be it
RESOLVED, that Amendment No. 2 to Site Lease Agreement between the Board of Water Commissioners of the City of Saint Paul and T-Mobile Central LLC providing for the installation of a fiber optic cable at the Board’s McKnight Road Standpipe site located at 393 North McKnight Road in Saint Paul, Minnesota is hereby approved, and that the proper officers are hereby authorized and directed to execut...
