Approving a Liquor Outdoor Service Area (Sidewalk) license with conditions to The Ox Cart Ale House, LLC d/b/a The Ox Cart Ale House (License ID #20150001092) for the premises located at 255 - 6th Street East in Saint Paul.

WHEREAS, The Ox Cart Ale House, LLC d/b/a The Ox Cart Ale House (License ID #20150001092) applied for a Liquor Outdoor Service Area (Sidewalk) license for the premises located at 255 - 6th Street East; and
WHEREAS, the licensee currently holds a Liquor On Sale - 101-180 Seats license, a Liquor On Sale - Sunday license and an Entertainment A license; and
WHEREAS, the license has also applied for a Liquor On Sale - 2AM Closing license; and
WHEREAS, the premises is located downtown so neither a petition nor a “good faith’ letter is required; and
WHEREAS, the Department of Safety and Inspections received no objections to the issuance of the Liquor Outdoor Service Area (Sidewalk) license; and
WHEREAS, the Council finds that the application is in order and there are no grounds for denial of a Liquor Outdoor Service Area (Sidewalk) license; now, therefore, be it,
RESOLVED, a Liquor Outdoor Service Area (Sidewalk) license is hereby granted to The Ox Cart Ale House, LLC d/b/a The Ox Cart Ale House (License ID #20150001092) for the premises located at 255 - 6th Street East in Saint Paul with the following conditions:
1. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is “Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment.” (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.
2. Licensee agrees to limit the placement of seating on the public sidewalk to the area and number of seats shown on the approved sidewalk seating plan on file with the Department of Safety and Inspections (DSI).
